As PlayStation kills physical discs, video game preservationists say the industry has left them no legal options — Is piracy the only way forward?

Sony's recent announcement that it will phase out physical discs for PlayStation has sparked anger among video game historians and preservationists. They say the industry has left them with no legal path to save gaming history. As digital storefronts become the only way to buy new games, the ability to archive titles for future generations is shrinking fast.

Preservationists argue that when a game is only available as a download, it can vanish the moment a company shuts down a server or revokes a license. Unlike physical discs, which can be stored, copied, and played without an internet connection, digital games exist at the mercy of the publisher. Major institutions like the Library of Congress and the Video Game History Foundation have tried to work within copyright law, but they face constant legal barriers. Laws like the Digital Millennium Copyright Act make it illegal to bypass encryption, even for the purpose of archiving a game that is no longer sold.

Without a legal exemption, many experts believe piracy is becoming the only reliable method to keep classic games alive. Fans who rip and share old titles often do so because no official version exists for sale. This creates a grim reality where the people who care most about preserving culture are forced to break the law to do it. As Sony pushes further into a disc-free future, the gap between what is legal and what is necessary for preservation grows wider. The industry has yet to offer a solution, and historians warn that without one, entire eras of gaming history will simply disappear.
