A new piece of legislation in California is taking aim at a niche but growing feature in the vaping industry: built-in video games. The proposed bill would make it illegal for manufacturers to sell or distribute any vaping device that includes a video game or similar interactive electronic display. If passed, companies caught violating the law could face a fine of up to $50,000 per violation.
Lawmakers behind the bill argue that adding games to vapes is a deliberate tactic to attract younger users. They claim that the combination of addictive nicotine delivery and engaging digital entertainment creates a dangerous lure for teenagers and children. The legislation specifically targets devices that feature screens capable of playing simple games, which have become more common in certain disposable vape products.
Supporters of the ban say it closes a loophole in existing regulations that focus on flavors and marketing but overlook the hardware's interactive features. Critics, however, question whether the bill goes too far. Some argue that the games are often rudimentary and not the primary driver of youth vaping. Others worry about the scope of the definition, potentially including basic menu screens or digital interfaces that are not strictly games.
The bill is currently making its way through the state legislature. If it becomes law, California would be the first state in the nation to specifically prohibit video game functionality on vaping products. The measure is expected to face strong opposition from the vaping industry, which may argue it infringes on product design and consumer choice.
